Radnor School District Loses On Reconsideration? Is Sunshine Upheld For Now?

Well, everyone on the Main Line has sure been following Judy Sherry's passionate quest for open records and accountability in Radnor. Her story has been discussed several times on this web site, including this post and this post and over at Round Radnor here and here.

There have also been several newspaper accounts which have been very unflattering to Radnor. Today we have news that Judy Sherry's victory has maybe once again upheld and Radnor School District was DENIED? As a matter of fact, read it for yourself HERE.

So is this the end of it? Will Judy be able to see what she requested to see or will this municipal tragedy of Shakesperian proportions continue to evolve? Read the Order dated July 29th, 2008...the end of it seems to contain a NEW wrinkle? Something about a June 30, 2008 Order being VACATED? Now what?

How much is this all costing taxpayers anyway? Will political pressure come to bear and will Judy EVER get her open records?

Thoughts on this are welcomed.

Regarding the Order being vacated, here is what I was told by a Lawyer:

Once an order is entered, the time for appeal runs from that date, even when there is a motion to reconsider. The appeal period is 30 days. The judge vacated the order so that the appeal time did not run against RTSD. Therefore, there is no decision, officially, at this time. The judge can reinstate his original decision, amend his decision or overturn his decision.

ONLINE EXTRA: Judge vacates ruling in Sherry case

A county judge has vacated his order requiring the Radnor School District to turn over documents related to 2007 salary increases for district administrators.

Judge Robert C. Wright did not elaborate on his reasons for voiding a June 30 ruling in favor of Judy Sherry of Radnor, who filed suit last summer when the school board refused to hand over a pair of documents it analyzed before voting for the raises.

In a two-paragraph order issued Tuesday, the judge said only that he needed "additional time" to weigh a motion for reconsideration filed by district Solicitor Michael Levin.

Whether Wright makes a U-turn and rules in favor of the district or simply amends or corrects parts of his order remains to be seen.
