Judge shows merits of group's lawsuit against LM

"A federal court judge had some sharp questions for the Save Ardmore Coalition's attorney on the timing of its lawsuit over Ardmore redevelopment at a hearing last week.

But U.S. District Court Judge Berle M. Schiller also had strong words for attorneys representing Lower Merion Township and other defendants.....But "I think the defendants recognize that this court is concerned about meaningful input for your clients," he told attorney Robert Sugarman, who represents SAC and several individual Ardmore business and property owners.

"If I find [the case] is not ripe, they're treading on very thin ice if they walk all over your clients and it comes back to me," he added....

...When Schiller again said he questioned whether the court has jurisdiction at this time, Sugarman offered a different option. "If you decide [the matter] is not ripe, put it on stay. Don't dismiss it," he suggested.

That would assure the case, if it proceeds later, would stay before Schiller."
